Improving the punishment of triad organizations and leaders
The two draft of the draft increased the punishment for organizing and leading crimes committed by underworld organizations and increased their sentences.
The specific provisions are: organization and leadership of underworld organizations shall be sentenced to fixed-term imprisonment of not less than seven years and confiscation of property; those who have participated actively shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years, and may also be fined or confiscated. Other participants shall be sentenced to three years' imprisonment, detention, control or deprivation of political rights, and may be fined together.
The previous draft stipulates that the organization, leadership and active participation in the organization of underworld organizations shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; other participants shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, control or deprivation of political rights.
Some departments and places have suggested that in the underworld organizations, the status and role of organizations, leaders and active participants and other participants in criminal organizations are different. It is recommended to stipulate penalties separately and appropriately increase the penalties of organizations and leaders.
The draft of this deliberation was amended accordingly.
